Estate Planning

Trusts, Wills, Powers of Attorney, Deeds to Trusts. Our office is dedicated to providing you with a complete and thorough set of documents for your unique situation. Estate planning doesn’t happen overnight. We work with you to develop a plan that provides for you, in the both the event that you cannot handle things for yourself while you are alive and also in the event of your death.

Real Estate Closings

The two most important parts of our representation of you in your purchase of your new home or parcel of land will be the title search, the settlement, and the recordation of your deed. Our attorneys and staff will conduct in-depth title searches and examinations and make sure you receive the title insurance you require for your protection. At closing, title documents will be thoroughly explained and any questions answered. Closing documents including your settlement statement or closing disclosure will be carefully prepared and reviewed at closing with you by one of our attorneys. We will insure that you and your funds are completely protected throughout the closing process and disbursement of funds.

Probate/Estate

The courts and legal system can be a difficult maze to understand, especially when you are mourning a recently deceased family member or friend. We can help ease the process. Our office works with the Personal Representative or the Trustee in administering the assets, creditors, and distributions involved in an estate or trust. We can assist the Personal Representative with all of these steps, as well as more complicated situations, such as the sale of real estate, or methods of handling disputes among the heirs and beneficiaries. The probate process can be emotional, as well as paperwork intensive. We make that necessary process much easier for you.

Derek M. Wenzel

Attorney

Derek M. Wenzel is a native of Haywood County. His father is Dr. Frederick Wenzel, who was a general surgeon in Haywood County for over thirty years, and his mother is Judy Wenzel. Derek Wenzel graduated from Tuscola High School in Haywood County at the top of his class and from Davidson College near Charlotte, NC with honors and a double major in Spanish Literature and Political Science. He received his law degree from Washington College of Law at American University in Washington, DC, where he also worked at a real estate law firm before moving back to Waynesville. Derek Wenzel is very active in the community, either being involved with or serving on the boards for such groups as the Haywood County Chamber of Commerce, Haywood County School Foundation, Folkmoot USA and the Knights of Columbus. He is also past president of the Haywood Rotary Club. Derek M. Wenzel’s practice focuses primarily on real estate transactions, in which he represents buyers, sellers and those refinancing. In doing so, he works carefully with everyone involved in the transaction on your behalf such as realtors and lenders. He is an approved attorney for title companies such as Investors Title, First Choice Title and Attorney’s Title.

Sarah P. Wenzel

Attorney

Sarah P. Wenzel handles estate planning, mainly through revocable living trusts, financial and health care powers of attorney, living wills, and other related documents. She also handles probate and estates, including court proceedings and accounting and other legal documents. Her clients are typically individuals and couples needing estate planning, as well as the Executor, Personal Representative, Trustee, or Guardian. She does not handle any estate disputes or litigation, and does not represent beneficiaries. She focuses on helping the named Fiduciary fulfill their responsibilities. Sarah Wenzel grew up in Connecticut, before finding her way to Western North Carolina. She graduated cum laude from the McDonough School of Business at Georgetown University with a Bachelor's of Science in Business Administration. Sarah then received her law degree with honors from Washington College of Law at American University in Washington, DC. In law school, she served for two years on the American University International Law Review, and as note and comment editor for one year. Sarah Wenzel is very involved in the Haywood County community. She currently serves as a Girl Scout Troop Leader and on the Board for Habitat for Humanity. In the past, Sarah has served the local community through Board of the Fund for Haywood County, an affiliate of the Community Foundation of Western North Carolina, on the Grants committee, and Altrusa International, Inc. of Waynesville as member, Scholarship Committee Chair in, and as President in 2007-2008. She has also volunteered for the Haywood County School Foundation and Folkmoot USA. Sarah is a member of the Fiduciary Law section and the Elder Law section of the North Carolina Bar Association.
